ARTICLE XV
TRANSFER POLICY
15.0 A transfer refers to any Agency action which results in the movement of a unit member, within the same job classification, from one work site or shift to another.
15.0.1 A transfer may be voluntary (initiated by a unit member).
15.0.2 A transfer may be involuntary (initiated by the Agency).
15.1 Voluntary Transfer: A unit member may request a voluntary transfer, in writing, wherein the unit member shall express preference for work location(s) or shift. When a new position is created or an existing position becomes vacant, the Agency shall offer the opportunity to transfer to bargaining unit employees serving in the same class in the Agency. All vacancies shall be posted by the Agency for not less than six (6) days at all work locations prior to being filled. Any employee in the bargaining unit may apply for a transfer to that position by filing a written notice with the Human Resources Department of the Agency.
15.1.1 If more than one employee wishes to be transferred to a particular vacancy, the employee with the greatest bargaining unit seniority shall be transferred.
15.1.2 In the event that two (2) or more employees have identical seniority, the employee to fill the position shall be selected by lot.
15.2 Involuntary Transfers: An involuntary transfer of probationary or permanent unit members may be initiated by the Agency for legitimate business needs.
15.2.1 An involuntary transfer may be made based upon the needs of the Agency as determined by the Chief Executive Officer, or designee. The Agency shall consider the preferences of the involuntary transferee when making such assignment. However, the needs of the Agency shall be paramount and, if necessary, shall take precedent over the preference of the involuntary transferee. 15.2.2 The Agency shall not arbitrarily or capriciously transfer employee(s) involuntarily. Upon written request, within five (5) days of the notification of an involuntary transfer, the unit member shall be given a conference with the Chief Executive Officer, or Designee, and written reason(s) for such transfer. 15.2.3 The Agency shall have the sole authority to determine when and where there is an opening, and to transfer unit members, when the Chief Executive Officer or Designee concludes that such a transfer is in the best interest of the Agency.
